A Resolution Concerning Repeal of an Ordinance by the Department of Public Safety at The University of North Carolina at Chapel Hill

Resolution of the Employee Forum
The University of North Carolina at Chapel Hill

 1. WHEREAS, the Mission of the Employee Forum is to constructively address the concerns of the Employees of the University of North Carolina at Chapel Hill, including the presentation of staff concerns to University officials, University General Administration and the citizenry of North Carolina; and;

2. WHEREAS, the Board of Trustees of the University of North Carolina at Chapel Hill did declare: “All resolutions heretofore adopted regulating traffic and parking on the campus are repealed. The repeal herein of these regulations shall not abate or otherwise affect any civil, criminal, or administrative action or proceeding concluded or pending on the effective date of this Ordinance; except as otherwise provided, this Ordinance may be amended in whole or in part by action of the Board of Trustees. The effective date of this Ordinance shall be August 15, 2008.” And;

3. WHEREAS, pursuant to ARTICLE I. GENERAL PROVISIONS; Sec. 1-2. Regulating; Delegating of Authority

1. The Chancellor is authorized to adopt and promulgate such rules and regulations and to establish such administrative procedures as he/she may deem necessary or advisable for the administration, interpretation, and enforcement of this Ordinance.

2. The Chancellor may delegate administrative responsibilities imposed on him/her by this Ordinance to the Director of Public Safety and other officers of the University that the Chancellor may choose.

3. The Department of Public Safety operates twenty-four hours a day, seven days a week. In-office customer service is available from 7:30 a.m. until 5:00 p.m., Monday through Friday, except on University-recognized holidays. Regulations may be enforced at any time deemed necessary by special event activities or other circumstances. And;

4. WHEREAS, pursuant to ARTICLE I. GENERAL PROVISIONS; Sec. 1-3. Posting Notice of Ordinance and Regulations

The Chancellor, through his designated administrative officers, shall cause to be posted a public notice of traffic and parking restrictions imposed by or pursuant to the authority of this Ordinance and by Chapter 116, Article 1, and Part 6 of the General Statutes of North Carolina. Once posted, these restrictions are in effect at all times unless otherwise stated. And,

5. WHEREAS, pursuant to ARTICLE I. GENERAL PROVISIONS; Sec. 1-4. Publications of Ordinance and Regulations

The Chancellor, through his administrative officers, shall cause copies of this Ordinance and regulations issued pursuant hereto to be printed and made available to students, faculty, and employees of the University. And;

6. WHEREAS, said Sections 1-2, 1-3 & 1-4 of ARTICLE I. GENERAL PROVISIONS hitherto have NOT been dutifully complied with: the Chancellor Thorpe as authorized has NOT adopted and promulgated such rules and regulations and established such administrative procedures as he/she may deem necessary or advisable for the administration, interpretation, and enforcement of this Ordinance; the Chancellor’s designated administrative officers, have not caused to be posted a public notice of traffic and parking restrictions imposed; the Chancellor’s administrative officers hitherto have NOT caused copies of this Ordinance and regulations issued pursuant hereto to be printed and made available to students, faculty, and employees of the University.

BE IT THEREFORE RESOLVED that the Employee Forum respectfully requests Chancellor Holden Thorp, to declare said Ordnance has been ineffectual until such time as DPS meets the requirements above.

BE IT FURTHER RESOLVED that a consequence all citations all be declared void, all fines refunded to said defendants and all record of citation be expunged.
